Study: Big Increase in Number of Women Paying Spousal Support, Child Support

The American Academy of Matrimonial Lawyers (AAML) found that our family law courts are increasingly becoming gender neutral. In more cases, women are being ordered to pay child support and spousal support, and men are more frequently being granted partial custody or sole custody.

On May 14th, 2018, the American Academy of Matrimonial Lawyers (AAML) released the results of a comprehensive study on gender and family law court in 2018. The evidence from this report matches up well with many other decades-long societal trends: the gender gap is shrinking in family law cases.

While men are still more likely to pay spousal support or child support, the amount of women that are paying both has increased dramatically in the past several years. This is a continuation of a long-term trend that first truly started to develop in the late 1970s. It was at that time that the Supreme Court of the United States struck down all family law rules that explicitly discriminated on the basis of gender.

According to the AAML study, 54 percent of U.S. family law attorneys state that they have seen a sharp increase in the number of women paying child support in the past three years. In addition, 45 percent of the surveyed family law lawyers state that they have seen a sharp increase in the number of women paying spousal support.

Beyond a shifting landscape of finances, American family law courts are also now far more likely to order shared custody than they were in the past. To be sure, 79 percent of family law attorneys report that they are seeing joint custody being awarded at a higher rate.

As noted by Syracuse, New York family law attorney Richard J. Bombardo, “In decades past, there were a lot of assumptions made by our family law courts, including that young children should generally be with their mother. That assumption has changed. Family law courts no longer explicitly favor the mother in child custody proceedings. Instead, modern family law courts strongly favor arrangements that encourage joint custody and shared parenting.”

That family and divorce courts have slowly become more gender neutral is something that both men and women should recognize. Times have changed, and it could have a significant impact on any individual case. A woman could be ordered to pay both child support and spousal support, and a father could potentially be awarded sole custody of the children over the objections of the mother.
